Recent years have seen renewed interest in exploitative abuses under competition law. While excessive pricing has traditionally been the main focus of enforcement in this area, attention has increasingly expanded to other forms of exploitative conduct, including data-related exploitation and unfair trading conditions.
These developments have also prompted renewed discussion about the role of competition law in tackling exploitative conduct, including what harms justify intervention and how far enforcement should go.
In December 2026, the OECD Global Forum on Competition will discuss the different legal frameworks and approaches used to address exploitative conduct across jurisdictions, as well as the key issues and recent developments shaping this area. It will also explore the types of conduct that may constitute an exploitative abuse under competition law, analysing enforcement trends and the theories of harm underpinning intervention.
