Enhanced Monitoring Report on the Implementation of the Standard on Transparency and Exchange of Information on Request 2026 Update (June)

Mauritius joined the Global Forum on 1 September 2009. Mauritius underwent its Second Round of EOIR Peer Review in 2017 (Mauritius’ 2017 Report),1 which assessed its legal and regulatory framework in force as of 22 May 2017 and its practical implementation, including in respect of EOI requests received and sent during the review period from 1 April 2013 to 31 March 2016. Mauritius received an overall rating of Compliant and the individual Elements were rated as follows:

Status of implementation of recommendations issued in the peer review report

Mauritius received four in-box recommendations in relation to Elements A.1 and A.2

This monitoring report assesses the actions taken by Mauritius to address the recommendations issued in its EOIR Peer Review Report and the peer input received for the monitoring period 2023‑2024.

The report concludes that all the four recommendations are “considered provisionally addressed in the context of the monitoring process, subject to detailed validation”. However, the report also notes that for one recommendation under Element A.1, there is need to monitor the implementation of recent amendments. Similarly, for the recommendation under Element A.2, there is need to demonstrate implementation of the legislative changes. Accordingly, the report adds two new recommendations and advises on actions required.

Element A.1: Availability of ownership and identity information

1. Availability of beneficial ownership information for domestic companies and partnerships

 

Recommendation (A.1, framework)	Mauritius is recommended to ensure the availability of information on the beneficial owners of all domestic companies and all partnerships.
Underlying factor	Beneficial ownership information on partnerships and domestic companies may not be available in situations where these entities do not hold a Global Business License or have a bank account with a Mauritius bank. However, in practice, Mauritius can demonstrate that a large number of such entities have a domestic bank account, which would allow for information on their beneficial owners to be identified pursuant to AML [Anti-Money Laundering] rules. (see paragraphs 77 to 100 and 120 of the Mauritius’ 2017 Report for more information)
Summary of actions reported	In addition to the existing AML obligations and company law requirements that were in place at the time of the 2017 Report, Mauritius has strengthened the multi-pronged approach to ensure availability of beneficial ownership information. Since 2018, all companies and partnerships have an obligation to identify their beneficial owners and submit such information to the Beneficial Ownership Register maintained by the Corporate and Business Registration Department (CBRD) as part of the Companies and Businesses Registration Integrated System (CBRIS). Further, guidance was issued in 2020 to companies on aspects of identifying beneficial ownership and recording such information. Mauritius has carried out awareness raising activities and enforcement measures, which have led to an increase in rate at which the relevant entities have submitted the necessary beneficial ownership information from 91% in 2020 to 98% by the end of 2024. Enforcement actions targeting the remaining 2% are on-going. On ensuring that the information submitted to the Beneficial Ownership Register is accurate, adequate and up to date, Mauritian authorities conduct various supervisory and enforcement activities, starting with data matching to cross-check submitted information against third party registers on legal ownership and national identification databases. Additional desk-based reviews are conducted on all the submissions made using a risk-based criteria. Where the submitted beneficial ownership information exhibits some risks, the entities concerned are selected for and undergo onsite inspections. Where non-compliance was identified, the entities concerned have been penalised and rectifications made within two months. Specifically on keeping the information submitted up‑to‑date, entities are required to report changes in beneficial ownership within 14 days, in addition to filing beneficial ownership information annually. In 2025, the legal and regulatory framework was enhanced to require beneficial owners to notify the entities of any changes relating to the persons’ beneficial ownership or otherwise face sanctions. This latter obligation became effective as of August 2025.
Conclusion	Mauritius appears to have taken appropriate actions to address the legal gap highlighted in the recommendation. The legal and regulatory framework has been strengthened to require all companies and partnerships registered in Mauritius to identify their beneficial owners, in line with the standard. The beneficial ownership information must be submitted to the Beneficial Ownership Register maintained by the Corporate and Business Registration Department as part of the Companies and Businesses Registration Integrated System. Further, Mauritius has taken comprehensive actions to ensure the implementation in practice of these obligations. Regarding the updating of beneficial ownership information, the new obligations enacted in 2025, requiring beneficial owners to notify entities on any changes in beneficial ownership, will facilitate entities to be aware of changes in their beneficial ownership. Beneficial owners who fail to notify the company on changes to their status as beneficial owners are liable to sanctions. Mauritius explained that entities would have to notify their owners that failure to notify any change in their status is an offence under the law and they may be liable to sanctions. However, it is not demonstrated how such sanctions will be applied to beneficial owners who are not resident in Mauritius. This change is recent and therefore, Mauritius is recommended to monitor the implementation of recent obligations to ensure beneficial ownership information held in the Beneficial Ownership Register is accurate, adequate and up to date for all relevant entities, in line with the standard.

Actions required	Existing recommendation: No immediate action required. New recommendation: In its next self-assessment, Mauritius should- Provide information on the implementation and enforcement of the new obligation introduced to ensure the updating of beneficial ownership information. Provide updated statistics on the compliance of companies and partnerships with their obligation to provide beneficial ownership information to the authorities and the verification mechanisms taken to ensure that beneficial ownership information is accurate and adequate.

2. Retention of beneficial ownership information for companies that cease to exist

 

Recommendation (A.1, framework)	Mauritius is recommended to ensure that beneficial ownership information is available for all companies that cease to exist.
Underlying factor	Beneficial ownership information for domestic companies that do not hold a Global Business License is not required to be held by any person following a company’s removal from the register. Also, records for companies that are voluntarily wound up are required to be retained by the liquidator for only three years. (see paragraphs 52 and 99 of the Mauritius’ 2017 Report for more information)
Summary of actions reported	The Companies Act, the Limited Liability Partnerships Act and the Limited Partnerships Act were amended in 2018 to require that the records of a company or partnership that ceases to exist be kept by the last directors or partners, for at least seven years, at a place in Mauritius. Additionally, 2018 amendments to the Insolvency Act require that liquidators maintain the records of liquidated entities for at least five years. Liquidators appointed under the Insolvency Act must be resident in Mauritius. Moreover, since 2018, companies and partnerships are required to identify their beneficial owners and submit such information to the Beneficial Ownership Register. The information submitted to this Register is kept indefinitely. Mauritian authorities have conducted sensitisation and enforcement activities that have led to 98% of all entities submitting their beneficial ownership information. The entities that have not submitted their beneficial ownership information have been struck off or are undergoing enforcement action. During the monitoring period 2023 and 2024, Mauritius received 14 EOI requests pertaining to entities that ceased to exist and successfully provided the requested beneficial ownership information.
Conclusion	Mauritius appears to have taken appropriate actions to address the recommendation. The legal and regulatory framework requires that the beneficial ownership information of an entity that ceases to exist be kept for at least seven years. Additionally, liquidators are mandated to keep records of liquidated entities for five years. Moreover, since 2018, entities are required to submit beneficial ownership information to a Beneficial Ownership Register, where such information is kept indefinitely. Mauritius has supervised and enforced the obligations relating to submitting beneficial ownership information to the register and such information is available to the authorities even when entities cease to exist.

3. Availability of legal ownership information for foreign companies conducting business in Mauritius

 

Recommendation (A.1, framework)	Mauritius should ensure that ownership information on foreign companies having a sufficient nexus with Mauritius or carrying on business or deriving income in Mauritius is available in all cases.
Underlying factor	Foreign companies establishing a place of business in Mauritius are required to provide legal ownership information only to the extent required by the laws of the incorporating jurisdiction. (see paragraphs 74 to 75 of the Mauritius’ 2017 Report for more information)
Summary of actions reported	The Companies Act was amended in 2018 to require that foreign companies having a sufficient nexus to Mauritius by either carrying on business in Mauritius or deriving income in Mauritius, provide legal ownership information to the Registrar at the time of registration. Further, any changes to the legal owners must be reported to the Registrar within one month, through a return of alteration. Mauritius has reported that all the foreign companies registered prior to this amendment have provided legal ownership information to the Registrar. As of December 2024, all the 157 foreign companies registered in Mauritius had provided legal ownership information. Moreover, foreign companies are also required to provide beneficial ownership information to the Corporate and Business Registration Department at the time of registration and to submit such beneficial ownership information annually. Mauritius reported that owing to these beneficial ownership requirements, the checks on the beneficial ownership information reported by foreign companies invariably lead to checks on whether the legal ownership information is available with the Registrar and up to date.
Conclusion	Mauritius appears to have taken appropriate actions to address the recommendation. The legal and regulatory framework requires foreign companies with sufficient nexus to Mauritius to provide legal ownership information to the Registrar, at the time of registration. Moreover, changes to such information must be reported within one month of occurrence. All the foreign companies registered in Mauritius have provided their legal ownership information to the Registrar. Further, owing to requirements for foreign companies to submit accurate, adequate and up-to-date beneficial ownership information, verification of the submitted beneficial ownership information invariably leads to checks on whether the legal ownership information is available with the Registrar and up to date.

Element A.2: Availability of accounting information

4. Retention of accounting records for companies and partnerships that cease to exist

 

Recommendation (A.2, framework)	Mauritius should ensure that accounting records for companies and partnerships that cease to exist are kept for a minimum period of five years.
Underlying factor	Accounting records for companies that are voluntarily wound up are required to be retained by the liquidator for only three years. Further, no clear obligation is placed on any individual to retain accounting records after a company or partnership is removed from the register. However, records of companies and partnerships that have Global Business Licenses will be kept by the registered agent. (see paragraphs 181, 204, and 205 of the Mauritius’ 2017 Report for more information)
Summary of actions reported	Regarding the accounting records of companies that have been removed from the Register, the Companies Act was amended in 2018 to require that the directors of the company ensure that the accounting records of such a company shall be kept for a period of at least seven years. Such records must be kept at a place in Mauritius or outside of Mauritius. If the records are kept outside of Mauritius, the records should be submitted and kept at a place in Mauritius at intervals not exceeding six months. Directors of a company that do not meet this obligation are liable to a fine not exceeding MUR 200 000 (EUR 3 797). This obligation covers companies that cease to exist without the involvement of a liquidator. Similarly, for the accounting records of partnerships that have been removed from the Register, the Limited Partnerships Act and Limited Liability Partnerships Act have been amended in 2018 to require that the general partners maintain the records of a partnership that ceases to exist, at a place in Mauritius, for a period of seven years. Partners that do not meet the above obligations are liable to a fine not exceeding 300 000 Mauritian rupees (EUR 5 928). Concerning the records of companies that are voluntarily wound up, the Insolvency Act was amended to increase the number of years that liquidators are required to maintain the accounting records of such companies from three to five years. Liquidators appointed under the Insolvency Act must be resident in Mauritius. Moreover, the accounting information submitted by companies and partnerships to the Registrar and the tax authorities as part of general compliance requirements when the entities are still active, are maintained indefinitely. Mauritius has reported that the obligations to ensure availability of accounting records of companies and partnerships that cease to exist have been well implemented. From 2021 to June 2024, Mauritius received 18 EOIR requests concerning entities that had ceased to exist, and the Competent Authority was able to obtain the requested information and to answer the requests adequately.
Conclusion	Mauritius appears to have taken comprehensive actions to address the legal gap highlighted in the recommendation issued in the peer review report. However, the implementation and enforcement in practice of these legislative amendments are yet to be fully ascertained. Mauritius has explained that they were able to successfully answer 18 requests received between 2021 and 2024 pertaining to the records of entities that had ceased to exist. However, Mauritius has not reported what supervisory checks have been conducted to ensure that the records of entities that ceased to exist after being removed from the Register (struck off) are maintained by the last directors or partners in accordance with the legal and regulatory framework, or how potential non-compliance is checked and sanctioned. Additionally, for entities that are voluntarily wound up, it is not demonstrated as to how the authorities have verified that liquidators are maintaining the accounting records for five years. Therefore, Mauritius is recommended to monitor the implementation of obligations that require accounting records for companies and partnerships that cease to exist to be kept for a minimum period of five years.

EOIR experience

Over the monitoring period 2023-2024, Mauritius received 331 requests and sent 40 requests. India, France and Kazakhstan were the top three partners in respect of incoming requests. United Arab Emirates, Singapore and South Africa were the key partners in respect of outgoing requests. Mauritius reported providing full and final responses in all the received requests, except one request which is still pending. The pending request is subject to a court process.

Ten members provided peer input on Mauritius. Peers reported general satisfaction in respect of their EOIR experience with Mauritius.

New developments having a bearing on the EOIR standard

No recent developments that have a bearing on the EOIR standard (other than those reported to address recommendations) have been reported by Mauritius or have otherwise come to light.

Next steps

Mauritius should continue taking actions towards implementing the standard effectively.

Under the first round of enhanced monitoring, two new recommendations have been issued to Mauritius.

5. Monitoring the implementation of requirements to update beneficial ownership information

 

Recommendation (A.1, practice)	Mauritius is recommended to monitor the implementation of recent obligations to ensure beneficial ownership information held in the Beneficial Ownership Register is accurate, adequate and up to date for all relevant entities, in line with the standard.
Underlying factor	In 2025, the legal and regulatory framework was enhanced to require beneficial owners to notify the entities of any changes relating to the individual’s beneficial ownership status in respect to the entity. These changes will facilitate entities to be aware of changes in their beneficial ownership, in a timely manner.

6. Monitoring the implementation of requirements to maintain accounting records for companies and partnerships that cease to exist

 

Recommendation (A.2, practice)

Mauritius is recommended to monitor the implementation of obligations that require accounting records for companies and partnerships that cease to exist to be kept for a minimum period of five years.

Underlying factor

The legal and regulatory framework has been enhanced to require that when entities cease to exist, the accounting records should be retained in line with the standard. Firstly, when companies cease to exist through voluntary winding up, the period for which the accounting records of such companies should be kept by liquidators has been increased from three to five years. Secondly when companies or partnerships are removed from the register (struck off) and cease to exist, the records of such entities must be maintained by the last directors or partners, respectively, for seven years. It is not demonstrated whether the implementation or enforcement of these obligations has been monitored.

The following next steps are expected from Mauritius:

• Submit its next self-assessment, including on the new recommendations issued, in 2028 under the second round of enhanced monitoring.

Views/response of the monitored jurisdiction

Mauritius acknowledges the PRMG's assessment and views the recommendations as being progressively addressed. The legislative enhancements brought since 2018 underscore Mauritius’ ongoing commitment to maintaining high standards in beneficial ownership transparency and accounting record retention.

The legislative amendments introduced in August 2025 regarding beneficial ownership further strengthen an already robust framework in line with the requirements of the Global Forum, as evidenced by the 98% compliance rate in submitting required information to the Beneficial Ownership Register by the end of 2024 and the successful response to all requests for beneficial ownership information. In line with PRMG requirements, Mauritius is committed to monitoring the implementation of these new regulations, despite challenges related to non-resident beneficial owners.

In terms of accounting records for entities that cease to exist, Mauritius has successfully addressed all requests for information, demonstrating effective adherence to the relevant requirements. We remain committed to monitoring the implementation of these obligations to ensure the effectiveness of verification mechanisms.

Mauritius reiterates its dedication to evolving its regulatory framework in line with international standards, with a focus on rigorous monitoring of new obligations. We will provide the requested information and statistics and are confident that the recommendations will be considered fully addressed in the next round of the Enhanced Monitoring Process.
