Italy joined the Global Forum in 2009. Italy underwent its Second Round of EOIR Peer Review in 2017 (Italy’s 2017 Report),1 which assessed its legal and regulatory framework in force as at 11 August 2017 and its practical implementation, including in respect of EOI requests received and sent during the review period from 1 October 2013 to 30 September 2016. Italy received an overall rating of Compliant and the individual Elements were rated as follows:

Italy received two in-box recommendations in relation to Elements C.1 and C.5.
This monitoring report assesses the actions taken by Italy to address the recommendations issued in its EOIR Peer Review Report and the peer input received for the monitoring period 2023-2024.
The report concludes that one recommendation is “no longer sufficiently material” and one is “in the process of being addressed” and advises on actions required.

The ratification process remains lengthy in Italy and generally exceeds two years. Since the peer review, Italy’s EOI network has grown significantly, owing to new jurisdictions joining the Multilateral Convention on Mutual Administrative Assistance in Tax Matters (Multilateral Convention). Italy’s EOI network currently comprises 171 jurisdictions (compared to 146 EOI relationships during the peer review). As regards EOI relationships not covered by the Multilateral Convention, Italy has ratified bilateral treaties with 19 of them and ratification of bilateral treaties with the remaining 2 jurisdictions (non-Global Forum members) is no longer pursued for reasons not related to EOI. |

Conclusion |
Although a swift ratification of all the treaties signed has not been ensured, Italy has a large EOI network, which will continue to grow as more jurisdictions join the Multilateral Convention. Thus, the need for bilateral EOI instruments has considerably diminished, and this recommendation can be considered as no longer sufficiently material. Italy is no longer required to report progress on the implementation of this recommendation, in application of paragraph 61 of the Enhanced Monitoring Methodology. |

Although response times have shortened since the first-round review from 15% to 30% of incoming requests responded within 90 days, further improvement is needed to ensure exchange of information in a timely manner in all cases. Over the monitoring period 2023-2024, Italy received 900 requests and sent 816 requests. France, Norway and the United Kingdom were the top three partners in respect of incoming requests. Switzerland, Ireland and France were the key partners in respect of outgoing requests. Italy reported providing full and final responses in 96% of all the received requests and indicated 3% as pending requests, while 1% of the requests were withdrawn by partners.
Twenty-one peers provided peer input on Italy and six peers have raised matters on timeliness of responses, general communication matters and lack of status updates. These matters are covered under the existing Recommendation 2 and an in-text recommendation on provision of status updates.
Italy has reported progress in the implementation of a central beneficial ownership register. These developments have a bearing on EOIR and are linked to in-text recommendations issued to Italy in its 2017 Report. They will be analysed in the next round of enhanced monitoring. Italy should provide more details on the implementation of the beneficial ownership register while reporting actions taken to address the in-text recommendations.
Italy should continue taking actions towards implementing the standard effectively.
