Read the final statement published by the Luxembourg NCP - 21 November 2019
On 6 May 2019, a group of former workers of Pharmakina SA and Pharmeg SA submitted a specific instance to the Luxembourg NCP alleging that the companies did not observe the Guidelines in relation to its chapters on employment and industrial relations, the environment, human rights, and corruption. Pharmeg SA, which owns Pharmakina SA, is a holding company located in Luxembourg with operations in the Democratic Republic of Congo (DRC).
The submitters requested that the NCP help cease the ongoing issues and sought remedy consisting of a compensation of USD 5 million for the dismissed employees, and an additional USD 10 million for all employees of the company for the alleged adverse impacts.
On 21 November 2019, the Luxembourg NCP published its final statement, not accepting the case as it concluded that the NCP has no territorial jurisdiction over the issues.
