Jonathan (Josh) S. Kallmer is a counsel in Crowell & Moring's International Trade Group and is based in the firm's Washington, D.C. office. Josh's practice focuses on international agreements, principally in the area of cross-border investment. An expert on the regulatory, policy, and geopolitical issues that companies face when investing overseas, he assists clients in developing international investment strategies and in using international agreements and other legal and policy tools to pursue business solutions. Josh advises clients regarding the implications of bilateral investment treaties (BITs) and the investment provisions of free trade agreements (FTAs) for their business objectives, including through influencing the negotiation of BITs and FTA investment provisions, evaluating BIT and FTA rights in the event of adverse government treatment, and leveraging these agreements to hold governments to account and achieve success. Beyond investment, and drawing on his experience in government, Josh also advises clients regarding a wide range of international trade policy matters and works closely with C&M International and Crowell & Moring's International Dispute Resolution Group to find practical solutions to clients' international business challenges. Josh was formerly Deputy Assistant U.S. Trade Representative for Investment. In that capacity, he was responsible for developing and implementing U.S. international investment policy. Previously, Josh was Assistant General Counsel at USTR, where he represented the United States in disputes before the World Trade Organization (WTO), including in litigation concerning government subsidies to large civil aircraft makers Airbus and Boeing, the largest dispute in the history of the WTO.
