Since March 2010, the Autorité de Contrôle Prudentiel (Prudential Supervisory Authority), or ACP, operating under the auspices of the French Central Bank, is in charge of the licensing and supervision of the banking and insurance sectors.
As regards supplementary pensions, the ACP’s competences include powers relating to the supervision of life insurance undertakings providing supplementary collective occupational pension products such as the Schemes under Article 83 of the French General Tax Code, as well as life insurance undertakings providing occupational pensions schemes within the framework of Article 4 of European Directive 2003/41/EC on the activities and supervision of institutions for occupational retirement provision (IORP Directive).
The ACP’s competence also include functions in the information/notification exchange with other E.U. supervisors relating to IORP operations under the Freedom to provide services / Freedom of establishment.”
