Attribution of Profits to Permanent Establishments – Current Status of the Project

The Committee on Fiscal Affairs has completed a review of the progress on the project on the attribution of profits to permanent establishments. It has agreed on next steps for publishing new versions of Parts I - IV of the report and a draft implementation package of proposed changes to the articles and the commentary of the Model Tax Convention.

The OECD’s Centre for Tax Policy and Administration (CTPA) is organising a consultation with business on Part IV (Insurance) of the Discussion Draft on the Attribution of Profits to Permanent Establishments. That meeting will take place on Friday, 31 March 2006, in Paris at the OECD offices.

Le 27 juin 2005 le Comité des Affaires Fiscales de l’OCDE publiait pour commentaires un projet de rapport sur l’Attribution de profits aux établissements stables des sociétés d’assurance. Les commentaires reçus sont maintenant disponibles.

Le Comité des Affaires Fiscales de l’OCDE a publié pour commentaires du public un projet de Rapport sur l’Attribution de Profits aux Établissements Stables – Partie IV (Assurance). Les Parties I-III de ce Rapport ont déjà fait l’objet de consultations détaillées mais c’est la première fois que la Partie IV est publiée. Le délai pour commentaires est fixé au 16 septembre 2005. En fonction de la nature des commentaires qui seront reçus, une réunion pourra éventuellement être organisée avec les commentateurs.

L'examen par l'OCDE de la législation et des pratiques mexicaines en matière de prix de transfert a conclu sur une évaluation globalement positive des systèmes en place et l'observation que beaucoup des leçons apprises au Mexique pourraient être utiles à d'autres économies dont les structures économiques sont similaires. Le rapport détaillé est désormais disponible en ligne.

In the light of the latest business comments, WP 6 will propose to the CFA that the process for taking this work forward be reviewed. It already seems clear, however, that the final versions of Parts I-III will NOT be released in January 2005 as originally intended. A final decision on these proposals will be made when the CFA meets at the end of January 2005.
