Arbitration to be an option in cross-border tax disputes, OECD countries agree

OECD countries have agreed to broaden the mechanisms available to companies and individuals involved in cross-border disputes over taxation by introducing the possibility of arbitration if other attempts to resolve disagreements fail.

Recent OECD initiatives aimed at resolving international tax disputes

The OECD Centre for Tax Policy and Administration (the CTPA) is organising, in cooperation with BIAC, a consultation between business and government on recent OECD initiatives to improve dispute settlement procedures under tax treaties.  The consultation meeting will take place on Monday, 13 March 2006, in Tokyo and will bring together representatives from the private sector and senior government officials of OECD Member countries.

OECD releases for public comment the "Draft Progress Report on Improving the Process for Resolving Tax Disputes"

OECD releases a progress report  "Improving the Process for Resolving Tax Disputes" for public comment.  Written comments are invited by 15 October to help in preparing a consultation to be held on 7 December with business representatives and other interested parties to discuss the progress report.  This builds on the successful consultation held on 17 December 2003 which assisted greatly in scoping the project.

Dispute Resolution: Country Profiles on Mutual Agreement Procedures (MAP) Made Public

Following successful consultations held in December 2003 with interested parties, including business representatives, and in the light of the identification of the need to improve the transparency of the MAP process, the OECD has decided to make available to the public "Country Profiles on Mutual Agreement Procedures" of OECD member countries through its website. These profiles contain information about the Competent Authorities' contact details, domestic guidelines for MAP and other useful information both for tax authorities and taxpayers.

OECD Aims to Improve International Tax Disputes Mechanisms

The OECD, in cooperation with the Business and Industry Advisory Committee to the OECD (BIAC) and with the support of the broader business community, held a public consultation in Tokyo to present its 2006 Public Discussion Draft and consult with business on specific proposals to improve the process for resolving international tax disputes.  Attending the conference were senior tax executives from large multinational companies, international tax experts and academics, representatives from OECD Member governments and key participants from the OECD’s groups dealing with this issue.
