    Evaluating Laws and Regulations - The Case of the Chilean Chamber of Deputies

    This report focuses on international practices of ex post evaluation, and particularly on the current efforts to conduct ex post evaluation of laws in Chile. It is divided in two main parts.The first part of the report provides information and guidance, examples of practice and references on the subject of ex post evaluation in OECD countries, particularly in the Legislative area. It looks at the different definitions of, and motivations for, undertaking evaluation. There is no single template for undertaking ex post legislative evaluation. The objectives and methods to be used will depend on factors such as the nature of the law to be evaluated and the parliamentary and governmental context in which the evaluation takes place.In the second part the report evaluates the current system and process of ex post evaluation of laws in Chile. It discusses the efforts made by the recently established Law Evaluation Department in the Chamber of Representatives, in the framework of the law making process of the country. It revises the current practices in both branches of government, executive and legislative,  to conduct ex post evaluation of laws and regulations, as well as the formal and informal mechanisms to prepare laws and regulations and their possible ex post review. The paper revises as well the current programme for law evaluation launched by the Chamber of Representatives and it analyses its main components, in particular methodological approaches and inclusion of citizens‘ perceptions as a tool to increase transparency.The report concludes with an assessment of the main challenges that the law evaluation work is facing in Chile and makes some recommendations related to institutional, methodological and governance issues.

    Meeting the Water Reform Challenge

    The need to reform water policies is as urgent as ever. Water is essential for economic growth, human health, and the environment. Yet governments around the world face significant challenges in managing their water resources effectively. The problems are multiple and complex: billions of people are still without access to safe water and adequate sanitation; competition for water is increasing among the different uses and users; and major investment is required to maintain and improve water infrastructure in OECD and non-OECD countries.   Despite progress on many fronts, governments around the world are still confronted with the need to reform their existing water policies in order to meet current objectives and future challenges. Building on the water challenges identified by the OECD Environment Outlook to 2050, this report examines three fundamental areas that need to be addressed whatever reform agendas are pursued by governments: financing of the water sector; the governance and institutional arrangements that are in place; and coherence between water policies and policies in place in other sectors of the economy. The report provides governments with practical advice and policy tools to pursue urgent reform in their water sectors.

    Institutional and Financial Relations across Levels of Government

    As financial markets put more and more pressure on governments to reduce their deficits and debts, sub-central  levels of government are a key player in the implementation of national strategies. The room for manoeuvre to implement consolidations strategies coordinated across levels of government highly depends on the institutional structure of intergovernmental relations, and the effectiveness of their multi-level governance structure. This was already the case for recovery strategies, in the beginning of the crisis. This report provides an overview of the institutional and financial relations across levels of government  that enables policymakers evaluate their position and identify good practices for mobilizing sub-central governments for national growth, equity and stability objectives. This report is divided into two parts: the first part is analytical and the second part provides institutional and quantitative country information and comparisons.

    Observatory of Public Sector Innovation: 1st meeting

    25 delegates from 16 countries, and a representative from the European Commission participated in the first meeting of the Observatory’s Task Force. The meeting provided a valuable opportunity to discuss the strategic directions and initial activities of the Observatory. At the end of the meeting, Task Force members supported the nomination of Canada and France as Co-chairs of the Task Force.

    Now more than ever, OECD countries are investing significant resources in regulatory policies and reforms. At the same time, governments are under increasing pressure to explain such reforms and their benefits to the public. Perception surveys are an important part of this process and they are being used by OECD members to measure how citizens and businesses view regulation in their countries.This guide helps officials use perception surveys to evaluate and communicate the results of reform processes. While the guide draws on examples from the regulatory field, it is also useful for other policy areas. In non-technical language, the guide clearly explains the challenges involved in the design and use of business and citizen perception surveys – and ways to overcome them. It also helps officials get the most out of survey results, whether conducted internally or by external experts.

    Ministerial Advisors - Role, Influence and Management

    Government leaders need high-quality and responsive advice to make informed decisions, particularly to help restore long-term economic growth. Indeed, in many countries ministerial advisors are appointed primarily in order to increase the responsiveness of government and help address strategic challenges faced by government leaders. At the same time, their sheer number and the opacity surrounding their status have prompted widespread concern. These are two findings that emerged from an OECD survey in 2010 into the work of ministerial advisors across 27 countries.
    This report examines the survey’s findings in order to better understand the important role advisors play and how they are managed. It considers why ministers use their services, how they are appointed, the special status they enjoy, the concerns they have prompted in the general public, and how reform may make them more accountable  and improve the transparency of their status.
