In this phase of the APEC-OECD Co-operative Initiative on Regulatory Reform, economies are continuing to carry out self-assessments of regulatory reform using the APEC-OECD Integrated Checklist that was endorsed by the OECD Special Group on Regulatory Policy in March 2005 and by APEC Leaders in November 2005.

At joint policy roundtable in Cairns Australia in June 2007, Korea and Australia each reported against the Checklist providing a comprehensive overview of the national regulation reform agenda for each country. The results of the Checklist underscored the degree to which the assessments of regulatory capacity, competition, and market openness are mutually supporting in the regulatory governance framework of an economy. It was evident that the Checklist was of assistance to officials examining the coherence of the systemic framework for making regulations, and evaluating whether it delivers the desired economic outcomes. The joint policy roundtable followed a day long seminar on competition policy co-organised by Japan and Australia.

In 2006, Hong Kong China, Chinese Taipei and the United States reported on the results of their self-assessments using the Checklist. At the 2007 meeting, these three economies reported back on progress made and on future plans to build on the lessons of their self-assessments. Hong Kong China reported support for a competition law and a competition commission. And Chinese Taipei discussed the problem of building organisational knowledge given the turnover of government officials.

All the economies that have carried out a self-assessment emphasise that a benefit of the Checklist is improved co-ordination and communication within the public sector as well as a frank appraisal of areas for improvement. Among the lessons are: how can policy officers in specialised or sectoral departments be better prepared to consider integrated policies? How can competition and market openness impacts be assessed and their potential conflicts reduced? How can regulatory impact assessment be integrated more effectively into the development of policy?

Commentary from some economies at the meeting highlighted the extent to which small economies may benefit from regulatory reform, as well as the implications for governance associated with a smaller public sector. The only critical comment was to note that more attention needs to be paid to trade and market openness issues in the self-assessments and the policy roundtable. After a third round of self-assessments in 2008 (when Peru hosts APEC), a synthesis of the lessons learned and an outline of a future work programme will be presented for consideration by Leaders who will meet in 2009, in Singapore.
Interest among APEC economies in the Checklist remains strong. Indonesia, which with support from Japan co-organised a symposium on the Checklist in mid-June, expressed interest in carrying out a self-assessment. Several economies welcome efforts by OECD to help civil servants and interested stakeholders to understand the concepts behind the Checklist questions as part of capacity-building. The Checklist is of interest to economies that have questions about the institutional pre-conditions for successful regulatory reform, and about how steps for implementing regulatory reform can be synchronised with the general development of the economy.

Future programme of work, 2008-09

The APEC Economic Committee has constituted a regulatory reform sub-group, consisting of Singapore, Chinese Taipei, Japan, Thailand, Peru and Australia. Under Australia’s leadership, the group will prepare a “Good Practice Handbook on Regulatory Reform” drawing on the principles in the checklist and the experiences of APEC economies and OECD member countries. This will be discussed at the first meeting of the APEC Economic Committee in 2008. The 2008 APEC Economic Report will include a chapter on competition policy based on the day-long 2007 symposium held in Cairns. Peru, as APEC host, will also prepare a chapter on this subject based on its experience. As noted above, in 2008, the third round of self-assessments using the Integrated Checklist will take place at an APEC-OECD policy roundtable during the second meeting of the APEC Economic Committee.
