    Investment treaties as corporate law: Shareholder claims and issues of consistency, International Investment Working Paper 2013/3

    Many investor-state dispute settlement (ISDS) claims are by shareholders for so-called "reflective loss" incurred as a result of injury to “their” company. This paper (i) compares the wide acceptance of such claims in ISDS with their general prohibition in advanced systems of national corporate law; and (ii) analyses policy issues raised by such claims (e.g., risk of double recovery, high legal costs, injury to creditors, etc.).

    This OECD report to the G20 sheds light on reforms by which governments in Southern Africa can manage and accelerate the shift towards greater private participation in infrastructure. It draws on lessons learned from investment policy reviews in countries from the Southern African Development Community.

    Global investment activity fell by nearly a third in the second quarter of 2013, after two consecutive quarters of increases, according to preliminary estimates in the October 2013 issue of FDI in Figures.

    Selon un nouveau rapport de l’OCDE, la Géorgie a considérablement avancé sur la voie de la réduction de la corruption au cours de ces dix dernières années. Pour conforter ces progrès, les pouvoirs publics doivent axer leur action sur le renforcement du professionnalisme au sein de la fonction publique et sur l’indépendance de l’appareil judiciaire.

    This paper examines how institutional investors can access green infrastructure, the extent to which this is currently happening, and the barriers to scaling up these investment flows. Based on four case studies, broader lessons are drawn for governments on the policy settings which may support investment in green infrastructure by institutional investors.
