Competition Law and Policy in Brazil

 The three institutions that make up the Brazilian competition policy system are CADE, the autonomous adjudicative body; SDE, the principal investigative body in the Ministry of Justice, and SEAE, the economic analysis body in the Ministry of Finance. Particular strengths of the system in Brazil include institutional dedication to autonomy, sound policy and fair procedure, an excellent leadership cadre and a supportive business community. There are weaknesses in the institutional structure and resources, leading to inefficiency and delay, as well as provisions about merger notification and leniency that interfere with efficient and effective law enforcement.
